VIDEO CONTEST OFFICIAL RULES

The 5X Video Contest (“Contest”) is sponsored by Jay Geier’s Scheduling Institute, with offices at 4125 Old Milton Pkwy, Alpharetta, GA 30005 (“Sponsor“).  Contest is governed by these official rules (“Official Rules”).  By participating in the Contest, each entrant agrees to abide by these Official Rules, including all eligibility requirements, and understands that the results of the Contest, as determined by Sponsor and its agents, are final in all respects.  Contest is subject to all federal, state and local laws and regulations and is void where prohibited by law.  Sponsor reserves the right to modify, suspend or discontinue this Promotion at any time.  MUST BE PRESENT AT THE 2018 QUARTER 1 5X EVENT TO BE ELIGIBLE TO WIN.

ELIGIBILITY
This Contest is not open to the general public. Contest is open to qualifying members of Sponsor’s 5X Program located in the United States that are in good standing and financially and operationally compliant with the membership terms and conditions as of the time of entry and winner selection (“Qualifying Members”).  No person will be entered in his/her individual capacity.  Entry for Contest is open to owners and employees of Qualifying Members who are (1) residents of one of the 50 US states and (2) twenty-five (25) years of age or older at time of entry. All entries will be submitted on behalf of an eligible business entity by an employee or individual owner of that business.  Any employee submitting an entry on behalf of the Qualifying Member must have authorization of his or her employer to submit the entry in order for that entry to be eligible.

Prize will be awarded to the Primary Owner of the Qualifying Member.  “Primary Owner” means majority ownership interest in the practice of the Qualifying Member.  For Qualifying Members with owners holding equal ownership interests (without a Primary Owner), the promotion prize will be awarded as determined collectively by all owners.

Employees, officers and directors of Sponsor and its agents, as well as members of their immediate families (defined as parents, spouses, children, siblings and grandparents) and individuals living in the same household as those individuals are not eligible to enter or win.  Sponsor has the right to verify the eligibility of each entrant.

LIMIT OF ONE ENTRY PER QUALIFYING MEMBER.

CONTEST PERIOD
Contest begins on January 1, 2017 and ends at 11:59 p.m.ET on December 31, 2017 (“Contest Period”).  All entries must be received by Sponsor on or before 11:59 pm ET on December 31, 2017 to be eligible.

HOW TO ENTER
To enter, entrant must submit one (1) video (a “Submission”) detailing “The story of their big year.”  Submissions can be submitted via upload instructions found on the www.thebigyear.com (“Contest Website”).  Submissions can be submitted via two methods:

  • via DVD mailed to the following address: Jay Geier’s Scheduling Institute, Attn: 5X Video Contest Promotion, 4125 Old Milton Parkway, Alpharetta, GA 30005; or
  • via YouTube by uploading the video to YouTube and sending the download credentials to Sponsor at: bigyear@schedulinginstitute.com Uploading video to YouTube is subject to the terms of use available at http://www.youtube.com.

Be sure to include the business name, phone number, address and e-mail address of the Qualifying Member and the name of the submitting individual along with the Submission. Failure to include this information with Submission may result in disqualification of your entry. Only entries submitted via the methods provided above will be accepted.

Video Requirements:  To be eligible:

  • Submission must not exceed 10 minutes in length.
  • Submission must be submitted in one of the file formats identified on the Contest Website and meet the other requirements identified on the Contest Website.

Entry restrictionsSubmissions must not: (i) contain any copyrighted works without permission of the copyright owner, (ii) contain any false or defamatory statements about any person or third party, (iii) contain any third party trademarks that suggest affiliation with any trademark owner without permission of such owner, (iv) contain the likeness of any person from whom entrant has not obtained proper consent as provided in these Official Rules, (v) infringe any third-party proprietary or personal rights (vi) contain any profanity, nudity, depictions of violence, threatening language, (vii) be inappropriate, indecent, harmful, discriminatory or obscene, or (viii) depict any act which is dangerous or suggests any person undertake a dangerous activity, as determined by Sponsor, in its sole and absolute discretion.

Entrant may not feature in a Submission any individual who is a party to any agreement with any third party that might interfere with entrant’s participation in this Contest or the use of the Submission by Sponsor as provided herein.  It is the entrant’s responsibility to verify such possible relationships.  Sponsor does not assume any responsibility or liability for any entrant’s failure to verify any third party relationships.

All Submissions must be in keeping with Sponsor’s image and may not be offensive, as determined by Sponsor, in its sole and absolute discretion. Once you upload your Submission, Sponsor (or its designees) will have the right, but no obligation, to review the Submission for compliance with these Official Rules, and Sponsor may disqualify any Submission for any reason as determined by Sponsor, in its sole and absolute discretion (including, without limitation, Submissions with unsuitable content or that are in apparent or potential violation of third-party rights or these Official Rules).

Rights of Privacy and Publicity of Others: By submitting a Submission, you represent and warrant that you have obtained written permission from each person whose name, image, likeness or voice (“Likeness”) is included in the Submission; that such person has granted you all necessary rights to use the person’s Likeness in the Submission and as described in these Official Rules; and that you can and will make written copies of such permissions available to Sponsor upon request.  If the Likeness of a minor is included, such grant of rights must include written permission from the minor’s parent or legal guardian authorizing the use of the minor’s Likeness on behalf of the minor.

Additional Entry Conditions:  All components of your Submission must be your original creation.  Modifying, enhancing, or altering a third party’s preexisting work or copying any other Submission or example videos or photographs does not qualify as an original creation.  Submissions must not have been submitted in any other contest or promotion, in whole or in part, or have won any other award.  By entering this Contest, you represent and warrant that you own all right, title and interest in your Submission, and have the authority to grant to Sponsor the rights provided in these Official Rules.  By entering this Contest, you irrevocably (i) consent to the posting of your Submission on YouTube, Facebook, and other Sponsor websites or mediums for viewing by the public and at the 5X Summit, and acknowledge that the Submission may be viewed by visitors or viewers of such sites and at the 5X Summit and reviewed and judged by Sponsor for the purposes of the Prize award, and (ii) represent and warrant that the entry information you submitted is true and accurate and that the Submission complies with these Official Rules.

Rights in and Use of Submissions: All entries, including all Submissions, in whole or in part, become the exclusive property of Sponsor and will not be returned.  By entering this Contest, each entrant agrees to assign to Sponsor all right, title and interest that entrant may have in and to his/her Submission, including, without limitation, all intellectual property rights and other personal and proprietary rights, without expectation of compensation or acknowledgment (other than the prize as may be awarded as set forth in these Official Rules).  If, for any reason, any of these rights may not be assigned, by entering this Contest, each entrant grants Sponsor (and those acting pursuant to the direction of Sponsor) the perpetual, irrevocable, fully-transferable right and license to use, reproduce, display, prepare derivative works from and publicly perform the entrant’s Submission for advertising, trade and promotional purposes in any media or manner worldwide, and to post the Submission on YouTube, Facebook, and other Sponsor websites or mediums for viewing by the public.  Sponsor reserves the right to modify or edit any Submission, in whole or in part, for content, clarity or any other reason, and each entrant waives any and all “moral rights” in and to his Submission.  Sponsor further reserves the right to decline to use the Submission for any reason, in its sole and absolute discretion, including, without limitation, the Prize winner’s Submission.  Entrants (including Prize winner) agree that there is no guarantee that Sponsor will make use of any rights granted to Sponsor in any Submission.

Any Submission that exceeds the specified size, is not submitted in the proper file format or otherwise fails to comply with the requirements of the Official Rules may be disqualified or not fully considered.

Sponsor has no obligation to advise an entrant of an incomplete or otherwise non-compliant entry. Sponsor is not responsible for lost, late, invalid, unintelligible, incomplete, garbled, or misdirected entries, which will be disqualified. Any automated computer receipt (such as a “thanks for entering message”) does not constitute proof of actual receipt of an entry by Sponsor.  Proof of submission of an entry will not be deemed proof of receipt.  Sponsor is not responsible for any Submission being copied from YouTube, Facebook or otherwise appropriated by third parties.  In the event of a dispute as to any entry, the authorized account holder of the e-mail address used to enter will be deemed to be the entrant.  The “authorized account” holder is the natural person assigned an e-mail address by an Internet access provider, online service provider or other organization responsible for assigning e-mail addresses for the domain associated with the submitted address.  Potential winners may be required to show proof of being the authorized account holder.

WINNER SELECTION

Each Submission will be evaluated by a panel of judges made up of representatives from Sponsor.  The judges will evaluate the Submissions based on the following judging criteria: 10% – Creativity; 20% – Team Involvement; 20% – Practice Statistics; 25% – Story of Success (showing impact of The Big Year); 20% – Leadership Advancement; 5% – Entertainment Value.

ROUND 1: The judges will select a minimum of eight (8) Submissions as potential contest finalists (“Finalists”). The Finalists will be announced at the 2018 Quarter 1 5X Event. A representative of the Qualified Member must be registered to attend and present at the time of the announcement to qualify as a Finalist.

ROUND 2: Submissions will be displayed during the Event. Some Doctors may be asked to do a presentation. Registered attendees at the Event will vote for their favorite Submission based on the voting mechanism provided by Sponsor at the Event.  The Submission receiving the most votes will be considered the potential prize winner, subject to verification.  In the event of a tie, the Submission with the highest score from Round 1 will be determined the potential prize winner.

The potential Prize winner must comply with these Official Rules in order to be confirmed the winner of the Prize.  The potential Prize winner must sign and return any required forms, including, without limitation, affidavits of eligibility, prize acceptance and liability and publicity release forms, and IRS-W9 forms, to Sponsor after delivery of the forms to him/her.  If a potential Prize winner fails to comply with these Official Rules or fails to return all of the required forms within the time specified, that potential Prize winner may be disqualified, and an alternative Prize winner may be selected by Sponsor from the remaining Submissions according to the judging criteria.  The return of the above-mentioned forms within the allotted time shall be solely the responsibility of the Prize winner; Sponsor is not responsible for delays in delivery.

PRIZE

TWO (2) Prizes to be awarded to the winning Finalist selected in Round 2

Prize 1 is a [insert year] Porsche 911 Targa 4 GTS. Vehicle is a previously owned vehicle that has been driven (with estimated mileage, as of 12/1/16 of 4,500 miles); prize is to be awarded “AS IS” and “with all faults” on the date of delivery, subject to existing, unexpired manufacturer warranties.

Prize 2 is $25,000 cash (awarded in the form of a check to the Primary Owner of the winning Qualifying Member) to be distributed as determined by that Primary Owner for the Leadership Team of the Qualifying Member,

SPONSOR IS NOT A MANUFACTURER, DISTRIBUTOR OR DEALER OF VEHICLES. SPONSOR MAKES NO EXPRESS OR IMPLIED WARRANTIES, REPRESENTATIONS OR GUARANTEES OF ANY KIND RELATIVE TO THE PRIZE, INCLUDING WARRANTIES AS TO CONDITION, MERCHANTABILITY AND FITNESS.

Sponsor disclaims all liability for the provision, use, malfunction, quality or nature of any third party product or service provided to winner.  POTENTIAL WINNER will be responsible for all costs, taxes, and expenses not spEcified as part of the PRIZE that may include, but is not limited to, insurance and all other costs incurred in claiming or using the vehicle.  POTENTIAL WINNER IS RESPONSIBLE FOR ALL APPLICABLE TAXES AND EXPENSES DURING HIS/HER OWNERSHIP AND OPERATION OF THE VEHICLE INCLUDING, BUT NOT LIMITED TO, INCOME, PROPERTY OR USE TAXES AND REPAIR AND MAINTENANCE COSTS.  POTENTIAL WINNER IS RESPONSIBLE FOR ANY DAMAGE TO THE VEHICLE AND ANY AND ALL LIABILITY INCURRED AS A RESULT OF OR ARISING FROM USE OF THE VEHICLE.

Prize winner is responsible for complying with all requirements related to registration, licensing and titling of the vehicle in prize winner’s state.  Prize winner must show proof of a valid driver’s license and insurability.

Potential winner must take delivery of and title to the vehicle at a location designated by Sponsor. Sponsor is not responsible for delivery of the vehicle to prize winner’s location.

ADDITIONAL LIMITATIONS
Prize is non-transferable, except as provided in these official rules.  No substitution of prizes is permitted; however, Sponsor reserves the right to substitute any prize with another of equal or greater value.  Sponsor and its respective parent, affiliate and subsidiary companies, agents, and representatives are not responsible for any typographical or other errors in the offer or administration of the Contest, including, but not limited to, errors in any printing or posting or these Official Rules, calculation of votes, the selection and announcement of any winner, or the distribution of any prize.  Any attempt to damage the content or operation of this Contest is unlawful and subject to possible legal action by Sponsor.  Sponsor reserves the right to terminate, suspend or amend the Contest, without notice, and for any reason, including, without limitation, if Sponsor determines that the Contest cannot be conducted as planned or should a virus, bug, tampering or unauthorized intervention, technical failure or other cause beyond Sponsor’s control corrupt the administration, security, fairness, integrity or proper play of the Contest. In the event any tampering or unauthorized intervention may have occurred, Sponsor reserves the right to void suspect entries at issue.  Sponsor and its respective parent, affiliate and subsidiary companies, agents, and representatives, and any telephone network or service providers, are not responsible for incorrect or inaccurate transcription of entry information, or for any human error, technical malfunction, lost or delayed data transmission, omission, interruption, deletion, line failure or malfunction of any telephone network, computer equipment or software, the inability to access any website or online service or any other error, human or otherwise. 

INDEMNIFICATION AND LIMITATION OF LIABILITY
BY ENTERING THE CONTEST, EACH ENTRANT AGREES TO INDEMNIFY, RELEASE AND HOLD HARMLESS SPONSOR AND ITS PARENT, AFFILIATE SUBSIDIARY COMPANIES, AGENTS, ADVERTISING AND PROMOTIONAL AGENCIES, AND ALL THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS FROM ANY LIABILITY, DAMAGES, LOSSES OR INJURY RESULTING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM THAT ENTRANT’S PARTICIPATION IN THE CONTEST AND THE ACCEPTANCE, USE OR MISUSE OF ANY PRIZE THAT MAY BE WON.  SPONSOR AND ITS PARENT, AFFILIATE AND SUBSIDIARY COMPANIES DO NOT MAKE ANY WARRANTIES, EXPRESS OR IMPLIED, AS TO THE CONDITION, FITNESS OR MERCHANTABILITY OF THE PRIZE.

SPONSOR AND ITS PARENTS, SUBSIDIARIES, AFFILIATES, ADVERTISING AND PROMOTIONAL AGENCIES, AND ALL THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS DISCLAIM ANY LIABILITY FOR DAMAGE TO ANY COMPUTER SYSTEM RESULTING FROM ACCESS TO OR THE DOWNLOAD OF INFORMATION OR MATERIALS CONNECTED WITH THE CONTEST.

PUBLICITY
By entering, each entrant grants Sponsor and its advertising and promotional agencies and providers and those acting under their permission the irrevocable and perpetual right to use his/her name, likeness, voice, comments, Submission for advertising and publicity purposes without payment of additional consideration, except where prohibited by law.

PRIVACY 

Except as otherwise provided in these Official Rules, information submitted to Sponsor will be treated in accordance with the terms of the Sponsor privacy statement, available at www.thebigyear.com.

INTELLECTUAL PROPERTY
The Contest Official Rules and all related web pages, content and code are the property of the Sponsor or authorized third parties.  The copying or unauthorized use of any of those materials, associated trademarks or any other intellectual property without the express written consent of its owner is strictly prohibited.

COPIES OF THE RULES AND WHO WON

Requests for copies of these Official Rules or a winner’s list (after March 25, 2018) may be sent to Sponsor, Attn: 5X Video Contest, 4125 Old Milton Parkway, Alpharetta, GA 30005.  All requests must be received by March 31, 2018.
